On 28 June 2015 ACA Lawyers hosted a panel discussion in conjunction with Experts Direct, ‘Class Actions and Litigation Funding.’ The panel comprised three experts: esteemed barrister Michael Lee SC; Moira Saville, partner at King and Wood Mallesons; and Susan Dunn, head of UK-based Harbour Litigation Funding.
The three panellists each delivered a short speech based on their own unique experiences of class actions in Australia and overseas, followed by some lively interaction and questions from the audience.
While Mr Lee and Ms Saville were well known to each other and many in the audience (their exchanges provided some light relief), Susan Dunn provided a fresh perspective from her position as a highly experienced lawyer, “Grand Dame” of Wales and veteran funder of large and complex litigation internationally. Of note was Ms Dunn’s positive appraisal of Australia’s class action regime in comparison to that of other jurisdictions, including the UK.
Questions from the audience traversed a number of topics, including the trend of class actions increasingly arising from mismanagement natural disasters; the impact of class actions on improving disclosure practices of Australian companies and the disproportionate power enjoyed by institutional investors as members of the plaintiff class.
